Cabili filed Petition for Certiorari with the Court of Appeals

Background/Description of the Disclosure

We refer to the case for illegal dismissal docketed as “Jose Roberto C. Cabili, Complainant vs. Semirara Mining and Power Corp., et. al., Respondents, RAB Case No. VI-08-10689-22, National Labor Relations Commission, Bacolod City.” In November 2022, Semirara Mining and Power Corporation (SMPC) disclosed that it received a copy of the complaint/summons dated August 30, 2022, and that SMPC shall file the necessary pleadings before the Labor Arbiter considering the termination from employment is based on cause.

On January 31, 2023, a Decision was rendered by the Labor Arbiter dismissing Cabili’s Complaint for illegal dismissal and money claims for lack of factual and legal basis. Cabili’s appealed to the National Labor Relations Commission (NLRC), which was dismissed on June 23, 2023, and his Motion for Reconsideration (MR) was denied on October 16, 2023.

Today, we received by registered mail a copy of Cabili’s Petition for Certiorari dated January 19, 2024 appealing the case to the Court of Appeals.
