Clarification of News Report

“NOW Telecom Inc. of businessman Mel Velarde has elevated its appeal to the Supreme Court to settle the P2.6 billion in spectrum regulatory fees or SRF and associated charges it allegedly owes the National Telecommunications Commission.

The company, through a 22-page comment dated 1 September 2023 filed before the SC, pointed out that the regulatory fees and penalties imposed were ‘erroneous’ and needed to be recomputed.

The Company confirms the news article that its associate NOW Telecom Company, Inc. has a pending appeal with the Supreme Court in connection with the Supervision and Regulation Fees (SRF) and other charges it allegedly owes the National Telecommunications Commission (NTC).

Likewise, the Company confirms that a Comment was filed before the Supreme Court to further clarify/explain its position that the SRF assessment made by NTC is erroneous and needs to be recomputed: citing established legal precedents in the treatment of Additional Paid In Capital (shall not be basis in computing the SRF when used to wipe out deficit) with the penalties and interests in computing the SRF only imposable when the debt is liquidated (i.e., known or determinable) and for delinquency to be confirmed.

NOW Corporation is not a party to this pending case.
