Background/Description of the Disclosure

>In a Resolution issued by Office of the City Prosecutor dated 27 February 2023, Serafica's Motion for Reconsideration was granted, and on the same date, a Motion for the Withdrawal of Information was filed with the RTC Branch 155 by the City Prosecutor of Pasig City.

> PHA received a copy of the Motion for the Withdrawal of Information on 30 March 2023, and thus on 11 April 2023 filed a Motion for Reconsideration for the Office of the City Prosecutor to reverse its Resolution dated 27 February 2023 and affirm its finding of probable cause for the filing of Information against Serafica.

> In a Resolution dated 14 April 2023, the City Prosecutor of Pasig City denied the Motion for Reconsideration filed by PHA, essentially affirming its withdrawal of information filed charging Serafica and Dela Cruz with Estafa filed before the Regional Trial Court of Pasig, Branch 155

> On 07 July 2023, the RTC of Pasig City Br. 155 DENIED the Motion to Withdraw Information filed by the City Prosecutor of Pasig City, and ordered the arraignment and pre-trial to proceed on 2 August 2, 2023.

> On 02 August 2023, during the scheduled Arraignment and Pre-Trial, Messrs. Serafica and Dela Cruz personally appeared

> Their respective counsels manifested that they have filed a Comment (for Serafica) and a Motion for Reconsideration (for Dela Cruz) on the Order of the RTC dated 07 July 2023

> Counsel for PHA manifested it has filed an Opposition to the said Comment (from Serafica) and since the Motion (from Dela Cruz) was filed by registered mail on 24 July, the court gave a period of 10 days within which to Comment

> Arraignment is deferred and will be held on September 13, 2023 at 8:30am.
