Background/Description of the Disclosure
Please be informed that the Company received the Decision of the Supreme Court En Banc in Water for All Refund Movement, Inc. (WARM) vs. Metropolitan Waterworks and Sewerage System, et.al. with G.R. No. 212581 in the evening of July 19, 2023 as transmitted by its external counsel. The Supreme Court En Banc denied the Petition for the issuance of a Writ of Kalikasan filed by WARM and affirmed the July 26, 2013 and May 12, 2014 Resolutions of the Court of Appeals denying the Petition on the ground that it is not sufficient in form and substance. The Supreme Court En Banc found that WARM failed to present evidence necessary for the determination of the Writ of Kalikasan's issuance with respect to the laws breached and the environmental damage caused by the operation of the combined drainage-sewerage system subject of the petition; that the allegation is different from sufficient and actual evidence; that WARM failed to pursue the appropriate administrative remedy; and that a Writ of Kalikasan cannot and should not substitute other remedies that may be available to the parties.
