Background/Description of the Disclosure
On 04 October 2023, NOW Corporation, through its President and CEO, was informed by its associate NOW Telecom Company, Inc., through its President and COO, that NOW Telecom has received a copy of the Decision of the Special Ninth Division of the Court of Appeals in connection with the Petition for Mandamus filed by NOW Telecom seeking to compel the National Telecommunications Commission and its Chairman to comply with the Resolution dated 01 March 2021 and Order of Automatic Approval dated 01 March 2021 issued by the Anti-Red Tape Authority (ARTA) which deemed automatically approved by operation of law NOW Telecom’s application for Provisional Authority to operate in certain frequency ranges. In dismissing the Petition for Madamus, the Court, in its decision, refrained from intervening in the “questioned’’ discretionary functions and prerogatives of the Executive department. NOW Corporation is not a party to the case. NOW Telecom disagrees with the Decision and shall file a Motion for Reconsideration.
