Receipt of a Writ of Kalikasan issued by the Supreme Court En Banc

Background/Description of the Disclosure

As of August 16, 2023, the Group's Ipilan Nickel Corporation and Celestial Nickel Mining and Exploration Corporation (“Private Respondents”) have been served a Writ of Kalikasan from the Supreme Court En Banc. They, along with other respondents, are directed to file a verified return within ten days of receiving the writ.

Petitioner mainly contends that Private Respondents operate without a Certificate Precondition (CP) from the National Commission on Indigenous Peoples (NCIP).

However, the Petition omits to state that Private Respondents are given exemption from a CP by the NCIP in 2006.

Filed under the Rules of Procedure for Environmental Cases, the Petition asks for the issuance of a Writ of Kalikasan against Ipilan Nickel Corporation because of its alleged unauthorized mining operations.

The writ solely obliges Respondents to provide a response. It does not stop the ongoing mining operations because the court has not granted the Petitioner’s application for a Temporary Environmental Protection Order.

The Group will respond promptly and appreciates the chance to conclusively address persistent misconceptions held by the same group and supporters about the Ipilan Nickel Project even though relevant authorities have consistently dismissed their concerns.
