NCIP-MIMAROPA’s Order Against Ipilan Nickel Project

Background/Description of the Disclosure

The Group’s Ipilan Nickel Project, operated by Ipilan Nickel Corporation (INC), has received on August 11, 2023 late afternoon a Cease and Desist Order (CDO) from the MIMAROPA Regional Office of the National Commission on Indigenous Peoples (NCIP)

The CDO cites the project's alleged failure to obtain a Certificate Precondition as the reason for halting its mining operations. But INC contends that it is exempt from this requirement due to its pre-existing mineral production sharing agreement with the government, established before the enactment of the Indigenous Peoples’ Rights Act of 1997.

INC is committed to utilizing all available legal avenues, including the option to appeal, challenge the CDO, and ensure the uninterrupted continuation of its operations. Throughout this process, INC is dedicated to collaborating closely with NCIP and other relevant parties to reach a speedy resolution that takes into account the interests of all stakeholders, particularly the rights of indigenous communities.
