Subject of the Disclosure

Supreme Court (“SC”) denies the Petition filed by Water for All Refund Movement (“WARM”) for the Issuance of a Writ of Kalikasan to enjoin MWSS and its Concessionaires from implementing a combined drainage-sewerage system.

Background/Description of the Disclosure

On 19 July 2023, Maynilad received a copy of the SC Decision dated 28 March 2023, denying the Petition filed by WARM for the issuance of a Writ of Kalikasan (the “Writ”). WARM, an organization composed of consumers of MWSS, filed the Petition for the issuance of the Writ to enjoin MWSS, Maynilad and Manila Water from implementing a combined drainage-sewerage system, alleging that its use prejudices the life, health or property of the people residing in the service areas of MWSS.

The Supreme Court en banc affirmed the decision of the Court of Appeals, finding the issuance of the Writ to be without basis as WARM failed to establish the requisites for its issuance.

In its decision, the Supreme Court held that WARM failed to present evidence on the (i) illegality of the implementation of the combined system; and (ii) causal link between the operation of the combined system and the alleged resulting environmental damage.
